Today we’ll discuss a recent decision by the Regional Administrative Court of Calabria, Reggio Calabria section — judgment no. 618 of September 23, 2025. The court declared inadmissible an appeal filed against the rejection of a residence permit renewal, ruling that the matter does not fall under administrative jurisdiction but rather under the competence of the ordinary court. The case concerned a foreign citizen who had applied to renew his residence permit. The administration rejected the request because the applicant had been absent from Italy for more than six months, in violation of the Presidential Decree no. 394 of 1999. However, the applicant submitted medical documents proving a long period of hospitalization and rehabilitation therapy due to serious health issues. The TAR clarified that the application should be interpreted as a request for renewal based on family reasons, not work-related ones. Therefore, it concerns a subjective right falling under the jurisdiction of the ordinary court. With this decision, the Tribunal reaffirmed a well-established principle: disputes concerning residence permits for family reasons and the right to family unity fall under the competence of the ordinary judge, not the administrative one. Il TAR Calabria dichiara inammissibile il ricorso sul rinnovo del permesso di soggiorno per motivi familiari
Il Tribunale Amministrativo Regionale per la Calabria, sezione staccata di Reggio Calabria, con sentenza n. 618 del 23 settembre 2025, ha dichiarato inammissibile il ricorso proposto contro il decreto con cui la Questura di Reggio Calabria aveva rigettato l’istanza di rinnovo di un permesso di soggiorno, ritenendo che la controversia rientrasse nella giurisdizione del giudice ordinario.
La vicenda trae origine dal diniego opposto al rinnovo di un permesso di soggiorno originariamente rilasciato per motivi lavorativi. Il provvedimento negativo era stato motivato dall’assenza prolungata del titolare dal territorio nazionale per oltre sei mesi, in violazione di quanto previsto dall’art. 13, comma 4, del D.P.R. 394/1999. Il ricorrente aveva giustificato tale assenza con un grave stato di salute, documentato da certificazioni mediche relative a un ricovero ospedaliero e a successive terapie riabilitative.
Il TAR, dopo aver esaminato le argomentazioni difensive, ha chiarito che l’istanza del ricorrente doveva essere qualificata come richiesta di rinnovo del permesso di soggiorno per motivi familiari, in quanto riconducibile a ragioni attinenti alla vita familiare e non a esigenze lavorative. Di conseguenza, ai sensi dell’art. 30, comma 6, del Testo Unico sull’Immigrazione, la giurisdizione spetta al giudice ordinario, competente per le controversie in materia di diritto all’unità familiare.
Il Tribunale ha quindi dichiarato il ricorso inammissibile per difetto di giurisdizione, con possibilità per il ricorrente di riassumere la causa dinanzi al giudice competente, ai sensi dell’art. 11 del Codice del processo amministrativo. Le spese di lite sono state compensate tra le parti.
La decisione conferma un orientamento giurisprudenziale ormai consolidato, secondo cui i provvedimenti concernenti il rilascio o il rinnovo del permesso di soggiorno per motivi familiari — così come quelli relativi al diritto all’unità familiare — non rientrano nella giurisdizione del giudice amministrativo, trattandosi di posizioni di diritto soggettivo e non di interessi legittimi.
