 Administrative Error in the Decree Flows System: TAR Puglia Orders the Issuance of the Residence Permit “Now for Then”

With a decision of significant systemic relevance, the Regional Administrative Court of Puglia – Third Section, published on 24 December 2025, addressed an issue that for years has generated litigation and uncertainty in practice: the management of entry quotas for seasonal work and the legal consequences of errors attributable to the Public Administration.

The case concerns non-EU nationals who lawfully entered Italy under the decree flows system, following the issuance of seasonal work authorisations. At a later stage, the Administration revoked those measures, alleging that the quotas had been exceeded and attributing the entry to an “IT error” or a material mistake. This led to the refusal of the residence permit and to the initiation of judicial proceedings.

The Court adopted a clear legal position: the verification of quota availability must be carried out ex ante, before the foreign worker’s entry, not ex post. Allowing entry and subsequently denying the residence permit on the ground of insufficient quotas effectively shifts onto the foreign national the consequences of an administrative malfunction for which they bear no responsibility. According to the Court, such an approach lacks legal rationality and is incompatible with the principles of fairness and proper administration.

The judgment upholds the appeal within the limits of the request for the issuance of a seasonal residence permit with “now for then” validity, recognising the applicants’ residual interest in regularising their legal status, also with a view to possible future administrative procedures. At the same time, the Court confirms—consistently with established case law—that a residence permit for job-seeking purposes cannot be granted in the context of seasonal work, as this is expressly excluded by the applicable legislation.

The ruling goes beyond the individual case. On the one hand, it reaffirms the Administration’s responsibility in managing migration flows; on the other, it safeguards the legitimate expectations of those who entered Italy on the basis of valid and effective administrative acts. In a context where the decree flows system is increasingly central to the labour market, yet structurally fragile from an organisational standpoint, this decision sets an important benchmark.

Con una sentenza di particolare rilievo sistematico, il Tribunale Amministrativo Regionale per la Puglia – Sezione Terza, pubblicata il 24 dicembre 2025, è intervenuto su una questione che da anni genera contenzioso e incertezza applicativa: la gestione delle quote di ingresso per lavoro stagionale e le conseguenze degli errori imputabili alla Pubblica Amministrazione.

Il caso riguarda cittadini extra-UE entrati regolarmente in Italia nell’ambito del decreto flussi, a seguito del rilascio dei nulla osta al lavoro stagionale. Successivamente, l’Amministrazione ha revocato tali provvedimenti, sostenendo l’esistenza di quote in esubero e riconducendo l’ingresso a un “errore informatico” o materiale. Da qui il diniego del permesso di soggiorno e l’avvio del contenzioso.

Il TAR Puglia compie un passaggio giuridico netto: la verifica della capienza delle quote deve avvenire prima dell’ingresso del lavoratore straniero, non dopo. Consentire l’ingresso e, solo successivamente, negare il permesso per una carenza di quote significa trasferire sullo straniero le conseguenze di un malfunzionamento amministrativo che non gli è imputabile. Un’impostazione che il Collegio ritiene priva di razionalità giuridica e incompatibile con i principi di correttezza e buon andamento dell’azione amministrativa.

La sentenza accoglie il ricorso nei limiti della domanda di rilascio del permesso di soggiorno stagionale con validità “ora per allora”, riconoscendo l’interesse residuo dei ricorrenti alla regolarizzazione della propria posizione, anche in vista di eventuali future procedure amministrative. Viene invece confermata, in linea con un orientamento giurisprudenziale ormai consolidato, l’impossibilità di rilasciare un permesso per attesa occupazione nel lavoro stagionale, espressamente escluso dalla normativa vigente.

Il provvedimento assume un valore che va oltre il singolo caso. Da un lato riafferma un principio di responsabilità dell’Amministrazione nella gestione dei flussi migratori; dall’altro tutela l’affidamento legittimo di chi ha fatto ingresso in Italia sulla base di atti amministrativi validi ed efficaci. In un contesto in cui il sistema dei flussi è sempre più centrale per il mercato del lavoro, ma al tempo stesso fragile sotto il profilo organizzativo, questa decisione segna un punto fermo.

Dans une décision administrative significative, l’Italie a une nouvelle fois confirmé que l’intégration effective dans la société peut jouer un rôle déterminant dans la protection des ressortissants étrangers contre l’éloignement. Le 18 décembre 2025, la Commission territoriale pour la reconnaissance de la protection internationale de Gênes a accordé la protection complémentaire à un ressortissant étranger, estimant qu’un retour forcé dans le pays d’origine entraînerait une violation disproportionnée des droits fondamentaux.

La protection complémentaire est une forme spécifique de protection prévue par le droit italien, régie par l’article 19 du décret législatif n° 286/1998 (loi sur l’immigration). Elle s’applique lorsque les conditions du statut de réfugié ou de la protection subsidiaire ne sont pas réunies, mais que l’expulsion ou l’éloignement serait contraire aux obligations de protection des droits fondamentaux, notamment au droit au respect de la vie privée et familiale.

Dans cette affaire, la Commission de Gênes a rejeté la reconnaissance du statut de réfugié et de la protection subsidiaire, tout en procédant à une évaluation autonome et individualisée de la situation personnelle du demandeur. L’élément décisif a été le niveau d’intégration réelle en Italie, en particulier sur les plans social et professionnel. La Commission a reconnu que l’intéressé avait construit des liens personnels et professionnels stables et que son éloignement entraînerait un préjudice grave et irréversible.

L’intérêt majeur de cette décision réside dans son raisonnement juridique. L’intégration n’a pas été considérée comme une récompense ou un facteur accessoire, mais comme un élément juridiquement pertinent de la vie privée, protégée par les normes européennes en matière de droits de l’homme. La Commission a conclu qu’un retour forcé constituerait une ingérence disproportionnée dans ces droits.

Cette approche s’inscrit dans une tendance plus large de la pratique administrative italienne, qui considère de plus en plus la protection complémentaire comme une garantie substantielle, et non comme une mesure résiduelle. Elle confirme que la politique de contrôle de l’immigration doit être constamment mise en balance avec l’obligation de respecter la dignité humaine et les droits fondamentaux.

Pour les étrangers résidant en Italie, cette décision délivre un message clair : la construction de liens réels et documentés avec le territoire peut produire des effets juridiques concrets. Le travail, les relations sociales et la stabilité à long terme ne sont pas de simples éléments factuels, mais peuvent devenir déterminants pour empêcher une mesure d’éloignement.

Pour les avocats et les praticiens, la décision de Gênes constitue un exemple important du fonctionnement concret de la protection complémentaire. Elle démontre que, même en cas de refus de la protection internationale, le droit italien prévoit des mécanismes visant à éviter tout éloignement en violation des droits fondamentaux.

Alors que les débats sur la migration se poursuivent en Europe, cette affaire rappelle un principe essentiel : l’intégration compte, non seulement sur le plan social, mais aussi sur le plan juridique.

The case

The dispute arose from the refusal by the Police Headquarters to issue a residence permit for work to a foreign national whose EU long-term residence permit had previously been revoked. During the administrative proceedings, a criminal conviction intervened, following a plea agreement, for offenses involving domestic abuse and personal injury.

Despite the existence of an employment relationship and the alleged presence of family ties in Italy, the Administration denied the residence permit on the grounds that the applicant posed a risk to public safety, deemed incompatible with the issuance of a residence title.

The principle affirmed by the Court

In its judgment of December 16, 2025, the TAR Marche dismissed the appeal and clearly affirmed that integration cannot be reduced to employment alone. While work is a relevant factor in assessing integration, it is not sufficient in itself to override a finding of social dangerousness, particularly where the criminal conduct affects fundamental interests protected by the legal order, such as personal integrity and family relations.

The Court emphasized that integration must be assessed in a substantive and comprehensive manner, including respect for the social and cultural values of the host country. In this context, conduct within the private and family sphere assumes full legal relevance, especially when the criminal acts occurred precisely within that sphere.

Prohibition of automatism and administrative discretion

Of particular importance is the Court’s interpretation of Article 5, paragraph 5, of the Italian Immigration Consolidated Act. The TAR reiterated that the prohibition of automatic decisions does not translate into a subjective right to obtain a residence permit. The Administration is required to conduct a balancing assessment between the foreign national’s interest in remaining in the country and the community’s interest in public safety. Such an assessment may legitimately result in a refusal.

The presence of family ties is not, in itself, decisive unless those ties fall within the strictly defined categories established by law, nor can they operate as a “shield” against conduct considered to be of serious social concern.

The nature of Article 9, paragraph 9, of the Immigration Consolidated Act

The judgment also provides a clear clarification regarding Article 9, paragraph 9, of Legislative Decree no. 286 of 1998. The possibility of issuing a different type of residence permit after the revocation of an EU long-term residence permit is characterized as a discretionary power of the Administration, not an obligation. The exercise of that power remains subject to verification of all statutory requirements, including the absence of any risk to public safety.
